Partnership and Referral Agreement

- Nature of the Partnership
This Agreement is entered into between ALL IN IBIZA NOW (hereinafter “The Agency”) and the Service Provider (hereinafter “The Partner”). The Agency acts as a luxury marketing and concierge intermediary, connecting high-net-worth clients with premium services in Ibiza and the Balearic Islands.
- Commission and Referral Fees
The Partner agrees to compensate The Agency for successful bookings or sales generated through The Agency’s website, AI Agent, or personalized itineraries.
- Standard Commission: The Partner agrees to a referral fee of 15% (unless otherwise negotiated in writing) of the total gross transaction value.
- Real Estate/Villas: For long-term rentals or sales, the commission shall follow the Balearic industry standard of 3% to 5%, depending on the contract value.
- Completed Transactions: A “Completed Transaction” is defined as any booking where the Partner has received payment from the client.
- Lead Tracking & Attribution
The Agency utilizes proprietary tracking technology, including:
- Unique referral “Pretty Links.”
- WhatsApp click-tracking data.
- Timestamped form submissions synced to Google Sheets.
The Partner acknowledges that any client who contacts them via these tracked channels is attributed to The Agency for a period of 12 months from the initial contact (the “Protection Period”).
- Invoicing: The Partner must notify The Agency within 48 hours of a confirmed booking from a referred lead.
- Settlement: Commission payments are due to The Agency within 7 days of the Partner receiving the final balance from the client.
- Deposits: If a deposit is collected directly by The Agency via the website, The Agency will remit the balance to the Partner minus the agreed commission fee.
- Quality Assurance & Service Standards
As Ibiza is a world-class luxury destination, The Partner guarantees:
- Maintenance of all necessary Spanish licenses (e.g., Licencia de Turismo, maritime permits).
- Provision of services at the highest professional standard.
- Pricing parity (The Partner shall not charge Agency-referred clients more than their standard public rates).
Either party may terminate this partnership with 15 days’ written notice. Any leads generated prior to termination remain subject to the commission terms for the duration of the Protection Period.
This agreement is governed by the laws of Spain and the specific regulations of the Autonomous Community of the Balearic Islands. Any disputes shall be settled in the courts of Eivissa (Ibiza).
